The First Mobile Systems LLC company ("First Mobile Systems" or "we" or "us" or "our" or other similar pronouns) wants you to share the things that matter to you most with friends, family and anyone else around you. It’s important to us that you trust us your information when you use the FIRST app ("FIRST Application") and other products and services offered on the website (all above mentioned collectively, "Services"). Please take a few minutes to read this Privacy Policy ("Policy"), so that you understand what information we collect, what we do with it and why.

Before you start sharing information through the FIRST, it’s important you to understand that by using our Services, you give us consent to collect, use, disclose, retain your personal information and other information, but we will never read or listen to the content you are sharing privately. You can be sure that we will only use your Personal Information as described in this Policy. This Policy may change over time.

Clarification of terminology: using this Policy, the phrase "Personal information" we mean information about you that can identify your name, postal address and e-mail address, billing information or telephone number, as well as other non-public information associated with such personal information. Using this Policy, the phrase "Anonymous information" we mean information that does not identify your identity or related to your Personal information data like aggregated data, general demographic information and IP addresses. Anonymous information does not necessarily identify any individual person.

FIRST’s Privacy Policy describes our information (including message) practices, including the types of information we receive and collect from you and how we use and share this information. You agree to our data practices, including the collection, use, processing, and sharing of your information as described in our Privacy Policy, as well as the transfer and processing of your information to the countries globally where we have or use facilities, service providers, or partners, regardless of where you use our Services. You acknowledge that the laws, regulations, and standards of the country in which your information is stored or processed may be different from those of your own country.

1. The collection and use of information

FIRST Application

When you install the Application, you will need to tell us your phone number, name and a photo (name and photo are not necessary), and to allow us access to the address book of your mobile device. For more information about why the application needs access to your personal data, please visit the FAQ page.

Copy phone numbers and names from your address book (but without e-mail addresses, notes or any other Personal information from your address book) will be stored on our servers and used solely to:

  • notification about the activity of your contacts in FIRST;
  • determine which of your contacts is already a user FIRST;
  • display contact names in the form they are recorded in your address book correctly;
  • sync contacts across all your devices when you run FIRST on Android, iOS, Windows OS, Mac OS, Linux OS.

A Copy of your address book (names and phones) is stored on a live database. This database is not backed up and not stored.

Your phone number will be used for identification purposes as your user FIRST ID.

FIRST can interact with the hardware and software services of your device's operating system solely to activate the service, place incoming messages, read the contents of the FIRST message with information for activation. WE DO NOT READ THE CONTENT OF YOUR OTHER MESSAGES.

Name and photo

If you provide us with your name and/or photo, it will be visible to other users of FIRST, if:

  • the user may have associated with your FIRST room;
  • You and them are members of the same group.

Online status and seen status

Other users will see the status of your connection (online, offline, the last time you were online), and did you look a message sent to you.

Location Information

FIRST allows you to attach your location to messages you send to other users or send a specific message with information about the location. If you want to share your location with a specific user or group of users, your location will be retrieved from your device and sent in FIRST. Application uses this information solely for this particular purpose and delete it from its servers once the message is delivered. In order to avoid any suspicion , FIRST do not share information about your location for any purpose, providing it exclusively for your specific needs.

Other services

When we provide you with access to group chats, you are solely responsible for the information and any other content that you post to these group chats, and should be aware that if you voluntarily disclose Personal Information (e.g. name, email address, telephone number) in these group chats, this information is publicly available, can be collected and used by others. This may result in unsolicited messages from third parties, and we can't control that. We have no control over users or visitors FIRST, and in no way responsible for any collection and use of information that you can publish open access in group chats. This Policy does not cover such disclosure of information. You should exercise caution when providing personal information about themselves in group chats. Please do not post on this Website any Personal Information that you do not wish to disclose.

Cookies and other automatically collected data

If you have permitted your computer to accept cookies, we may use cookies on the Website. Cookies are pieces of information that a website transfers to the hard drive of the individual for the purposes of accounting. Cookies facilitate the viewing of web pages, storing your preferences, and the usual route of browsing the Site. Cookies can be used to analyze Site usage, improve and customize the content and layout of the Website, and for other purposes in support of user. When you request pages from our Website, our servers may record your IP address and your domain name. Your IP address is used to help identify you and to gather demographic information about our members and users in General, but does not include information that would identify you personally. Our servers may also record the referring page from which you came to us (such as other websites or search engine); the pages you visit on the Website; the website is where you leave our Website; the ads you view and/or open; other information about your type of web browser, computer, platform, related software and settings; search queries that you enter on the Website or linked site; other actions and data on the Internet that are logged by our servers. We use this information for internal system administration, to help diagnose problems with our servers and to administer our Service. Such data can also be used to collect information, such as country of origin and Internet service provider.

We will not link any Personal information, including email addresses, with aggregate data of our users.

Any of these actions concerning information on the use of the Site may be carried out on our behalf by our partners and service providers involved, in particular, Analytics and email management.

Sites of third parties and privacy practices

You can go to our Website and/or download the FIRST App from other websites. In addition, our Website may contain links you may leave our Site and go to other web sites. Such web sites are not subject to control by First Mobile Systems, and the possibility exists that have a different privacy policy. Our Policy applies solely to Personal information collected on our Website or while using our Services and/or interact with FIRST. You should exercise caution when posting any Personal information online. We do not accept any responsibility for such websites.


First Mobile Systems uses Google Analytics and Yandex.Metric for anonymous account information about the behavior of visitors/users of the Website and FIRST App and standard data. This information (including your IP address, data storage, technical support, database management, web Analytics and information processing) helps us analyze and evaluate the use of the FIRST Application and Website, to further improve the provided features and services. No information personally identifying in these reports is not included. Google Analytics and Yandex/Metric may gain access to your information only for the purposes of performing these tasks on behalf of the FIRST, and under obligation similar in those in this privacy Policy. To learn more about the terms that govern Google Analytics and Yandex.Metrics, please read the Google Analytics terms of service and terms of use of Yandex.Metrics. We never use (and do not allow any third party to use) the statistical Analytics tool to collect any Personal information of visitors or users. Google will not associate your IP address with any other data held by Google. Neither we nor Google will link, or seek to establish a link between IP address and identity of a device user. We do not link any collected on this site with any personally identifying information from any source, except when you expressly provide such information by filling out the form on our web site.

2. Sharing and disclosure of information

We do not share, rent, sell, or distribute any information about our users to third parties, except as noted below. We may disclose your Personal information, if we believe such action is necessary to:

  • to the requirements of law or judgments against us;
  • protect our rights or property (including enforcement of our agreements);
  • ensure the personal safety of users of our Services or members of the public in extraordinary circumstances.

To provide you with First Mobile Systems products, we may sometimes, if necessary, share your Personal information (excluding your address book and related information) and transmitting data with trusted partner service providers and/or agents, for example: banking organizations or other providers of payment and analytical services, customer support or hosting. First Mobile Systems will always require these third parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant legislation. First Mobile Systems will never provide information about your address book with any third party, except as may be required by law (see below).

Then there are the cases in which we may share your Personal information with third parties who are our reliable partners. When new partners we will immediately updated this description:

  • We use third parties to send you an authentication SMS when you register FIRST. To send an SMS, we send one of these companies your phone number and control the message. The contract requires these third parties to use your number exclusively for the transmission of the authentication SMS.
  • We may use push notification services to notify you about various application-related events. In such cases, a part of the notification can be a telephone number or the name of the person calling you or sending you a message. The relevant data is sent to the service provider push notification for delivery to your device.

Regardless of the foregoing, the SMART TELECOM server is used to store your Personal information are owned and hosted by OVH. To learn more about measures taken by OVH to protect the security of their servers and your Personal information, follow the link.

We may disclose information about you in cases where this is needed to ensure national security, law enforcement, or other issues of public importance.

We may periodically ask you for information about your experiences, which will be used to assess and improve the quality of services. You are in no way obliged to provide such information to us. All information of any kind that you choose to submit in feedback forms on the Website or in any surveys, participation in which accept, used to study the feedback and improve the software, products and web site First Mobile Systems.

We may send you messages about faults and problems with the provision of services. We also reserve the right to use email FIRST or SMS to notify you of any claims related to your use of our software, website and/or products, including without limitation claims of violation of third party rights.

We can ship to you via FIRST notification when someone has tried to contact you. We also can use the FIRST to keep you up to date with news about our software products that you have purchased and/or messages about other products First Mobile Systems and related information.

3. Age restrictions

Web-site and software clients of First Mobile Systems are not intended or designed to attract people under the age of 13, and we do not intentionally or knowingly collect on our websites Personal information of people under 13 years of age (or older in some jurisdictions). We encourage parents to be involved in the online activities of their children to ensure that any information about the child is not going without parental consent.

4. Security

We take reasonable precautions to protect Personal information from misuse, loss and unauthorized access. Despite the fact, that we cannot guarantee that Personal information will not be a subject to unauthorized access, we have physical, electronic, and procedural safeguards to protect Personal information. Personal information is stored on our servers and protected by secured networks to which access is limited to a few authorized employees. However, there is no 100% secure ways to transfer data via the Internet and electronic data storage.

5. Business transformation

In the event that we undergo a transformation of the business, such as a merger, acquisition by another company, selling all or part of our assets, Personal information will likely be among the transferred assets. As part of this transaction the new entity will have to commit themselves to provide the level of protection of your Personal data, similar to those described in this privacy Policy. In the absence of such a commitment we will carry out the business transformation.

We will post a notice on the Website in the event such change in ownership or control of the Personal information to such transfers.

6. Changes in Policy

From time to time we may revise this Policy. We reserve the right to update or modify this Policy, or any other of our policies or practices, at any time with or without notice. However, we will not use your Personal information in any way substantially different from those described in this Policy without giving you an opportunity to opt-out of such use. 7. Change or remove information

If you have provided us with your email address and want to update it, you can do in your dashboard or by sending us an email at

If you no longer wish to receive notices from us by e-mail, such as offers, updates and news you can opt out of receiving such emails by following the instructions in each email.

Your messages history is stored on the server for 30 days. Removing the app from your device and installing it again on the same or another device, you will be downloaded the message history for the last 30 days of use. 31 day history is removed. If you did not communicate to the application more than 30 days your history is empty.

Contacts in your phonebook are downloaded and stored on the server when you install the app constantly being updated.

8. FIRST Services

8.1. Google Places API

We use the Google Places API for displaying our Services. Google's Privacy Policy ( is an integral part of the Google Places API. All users of our app automatically accept the Google Terms of Service (
